Rules and Regulations for the State of North Dakota

Sales Tax Law:

According to 57-39.2-04 (31), “gross receipts from the sale of money, including all legal tender coins and currency, and from the sale of precious metal bullion that has been refined to a purity of not less than nine hundred ninety-nine parts per one thousand and is in such form or condition that its value depends upon its precious metal content and not its form” are not subject to sales tax.

NPMEX required to collect tax on some items shipping to North Dakota, however sales tax will not be charged for any Legal Tender coins nor .999 fine Gold, Silver, Platinum, or Palladium bullion items as they are exempt from sales tax when shipping to a North Dakota address.

The State of North Dakota requires the collection of taxes on certain products sold by NPMEX and delivered to a North Dakota address. These taxes must be collected on (1) copper products; (2) precious metal bullion which does not meet certain purity requirements; (3) accessory items; and (4) processed items. All other products sold by NPMEX are exempt from these taxes.

The following definitions apply to products on which taxes must be collected in North Dakota:

  • Purity Requirements: Precious Metal bullion that has not been refined to a purity of at least .999 fineness.
  • Accessory Items: Items such as holders, tubes or coin flips.
  • Processed Items: Precious Metals that have been processed by third parties into items valued on more than their Precious Metal content, such as jewelry, statues or colorized coins.

Sales taxes in North Dakota are calculated at checkout on the NPMEX website based on
(1) the taxability of products sold by NPMEX in North Dakota set forth above, and
(2) the specific tax rates established by the taxing jurisdiction of the delivery address in North Dakota.

Capital Gains Tax:

Gold and silver are subject to capital gains taxation when exchanged for Federal Reserve notes or when used in barter transactions.
