Rules and Regulations for the State of North Carolina

Sales Tax Law:

In 2017, North Carolina passed a sales tax exemption on precious metals. House Bill 434 exempts “sales of non-coin currency, investment metal bullion, and other investment coins.”

Investment coins is defined as “numismatic coins or other forms of money and legal tender manufactured of the metal under the laws of the United States or any foreign nation with a fair market value greater than any statutory of nominal value of such coins.”

Investment metal bullion is defined as “any elementary precious metal that has been put through a process of smelting or refining and that is in such state or condition that its value depends upon its content and not upon its form.” The statute says that “investment metal bullion does not include fabricated precious metal that has been processed or manufactured for one or more specific and customary industrial, professional, or artistic uses.”
Non-coin currency is defined as “forms of money and legal tender manufactured of a material other than metal under the laws of the United States or any foreign nation with a fair market value greater than any statutory or nominal value of such currency.”
NPMEX is required to collect tax on some items shipping to North Carolina, however sales tax will not be charged for Gold, Silver, Platinum, or Palladium bullion items as they are exempt from sales tax when shipping to a North Carolina address.

The State of North Carolina requires the collection of taxes on certain products sold by NPMEX and delivered to a North Carolina address. These taxes must be collected on (1) copper products; (2) any products that are not smelted or refined; (3) any coins that do not have a value beyond their statutory or nominal value; (4) accessory items; and (5) processed items. All other products sold by NPMEX are exempt from these taxes.

The following definitions apply to products on which taxes must be collected in North Carolina:

  • Accessory Items: Items such as holders, tubes or coin flips.
  • Processed Items: Precious Metals that have been processed by third parties into items valued on more than their Precious Metal content, such as jewelry, statues or colorized coins.

Sales taxes in North Carolina are calculated at checkout on the NPMEX website based on
(1) the taxability of products sold by NPMEX in North Carolina set forth above, and
(2) the specific tax rates established by the taxing jurisdiction of the delivery address in North Carolina.

Capital Gains Tax:

Gold and silver are subject to capital gains taxation when exchanged for Federal Reserve notes or when used in barter transactions.
